Is kratom legal in Florida right now?
Yes, at the state level. Florida has not banned kratom. Instead, it regulates kratom through the Florida Kratom Consumer Protection Act (KCPA), which establishes safety and labeling rules while keeping kratom legal and available to adults.
Kratom is not a controlled substance in Florida or at the federal level. Adults 21 and older can legally buy, possess, and use kratom throughout the state — everywhere except one county.
The one big exception: Sarasota County
This is the most important thing for any Florida buyer to know. Sarasota County banned kratom in 2014, before the statewide KCPA existed. Under a local ordinance, the county classifies kratom as a designer drug, making it illegal to buy, sell, or possess within county limits.
This local ban still stands and operates independently of state law. If you are in Sarasota County — or traveling through it — kratom is illegal there regardless of the fact that it is legal everywhere else in Florida. Penalties fall under the local ordinance and can include a misdemeanor charge.
Outside Sarasota County, kratom remains legal across all other Florida counties and cities.
What the Florida KCPA requires
Florida's Kratom Consumer Protection Act took effect in 2023 and was strengthened by later legislation. It focuses on consumer safety rather than prohibition. The core requirements include:
Age 21 and older. Florida sets one of the stricter age thresholds among states with kratom laws. Sales to anyone under 21 are prohibited, and vendors must verify age.
Accurate labeling. Products must be labeled honestly and completely so buyers know exactly what they are getting.
No adulterated or synthetic products. Products cannot be contaminated or contain synthesized kratom compounds. The state has also acted specifically against concentrated 7-hydroxymitragynine products.
Regulatory oversight. The Florida Department of Agriculture and Consumer Services (FDACS) has authority to enforce these rules, with penalties for violations.
A note on concentrated 7-OH products
Florida has moved specifically against concentrated 7-hydroxymitragynine (7-OH) products — the enhanced, potent extracts that are distinct from plain leaf powder. This is a nationwide trend: regulators are increasingly separating natural leaf kratom from concentrated 7-OH.
At Rimba, this is not a concern for us or our customers, because we sell plain leaf powder only. We do not carry 7-OH products or enhanced extracts of any kind.
Is the law going to change?
Florida's legislature periodically considers bills that would add requirements — for example, retail permitting or tighter processor rules. These generally aim to formalize the market rather than ban kratom. Nothing is final until it passes, and we update this page when the law changes.
